Welcome to Lex ("we," "our," or "us"). By accessing or using the Lex application and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Lex is a digital reading platform that allows users to read eBooks, organize their personal libraries, track reading progress, and discover new books. The Service includes features such as:

• eBook reading with customizable settings
• Personal library management and bookshelves
• Reading progress tracking
• Book discovery and recommendations
• Upload and management of personal eBook files
• Highlighting and bookmarking features

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You must be at least 13 years old to create an account and use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. User Content

You retain ownership of any content you upload to the Service, including eBooks and personal notes ("User Content"). By uploading User Content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

You represent and warrant that:

• You own or have the necessary rights to upload the User Content
• Your User Content does not infringe any third-party intellectual property rights
• You are responsible for ensuring your uploaded content complies with applicable laws

5. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that infringes copyrights or other intellectual property rights
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its servers

8. Subscription and Payments

Certain features of the Service may require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date.

9. Cancellations, Refunds, and Chargebacks

Cancellation. You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No partial refunds are issued for unused time within a billing period.

Refunds. If you are not satisfied with the Service, you may request a full refund within 7 days of your initial purchase. Refund requests should be submitted by contacting our support team. Refunds are not available for subscription renewals, partial billing periods, or accounts that have been terminated for violations of these Terms.

Chargebacks. If you have a billing concern, please contact our support team before initiating a chargeback or dispute with your bank or payment provider. Unauthorized chargebacks may result in suspension of your account and collection of any outstanding amounts owed. We reserve the right to dispute any chargeback we believe to be fraudulent or unwarranted.

10. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting us or using the account settings feature. Upon termination, your right to use the Service will immediately cease.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEXBOOKS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. LexBooks, Inc. is a Delaware corporation with principal operations in California.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the effective date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
